Welcome to Heynds! These Terms of Service ("Terms") govern your access and use of our software, application, and artificial intelligence assistance features (collectively, the "Services"). By using Heynds, you fully accept these Terms as well as our Privacy Policy.
Access to Services
You must be at least 15 years old to use Heynds. If you are between 15 and 18 years old, the agreement of a parent or legal guardian may be required depending on the legislation of your country.
To access the Services, you must acquire a valid license key. You are solely responsible for the confidentiality and security of this key. We reserve the right to deactivate any key obtained fraudulently or used in violation of these Terms.
Content and Artificial Intelligence
You retain full ownership of the text, data, or queries (the "Inputs") that you submit to Heynds. Content generated by AI (the "Outputs") also belongs to you, subject to the licensing terms of the third-party AI providers we use. Heynds only accesses your content for the strict purpose of operating the Services.
Artificial intelligence can sometimes generate inaccurate or inappropriate information. Heynds does not guarantee the accuracy of the Outputs, and it is your responsibility to always verify the content before using it. Furthermore, the very nature of AI implies that other users may obtain similar or identical Outputs, over which you cannot claim any exclusivity.
Acceptable Use
You agree to use the Services in compliance with applicable laws. It is strictly forbidden to exploit Heynds for abusive, illegal, harassing, or unethical purposes. You also guarantee that the content you submit does not violate any third-party rights, particularly intellectual property rights.
Payments and Termination
Our Services may be offered as subscriptions or one-time purchases. You are responsible for paying the rates indicated at the time of purchase, including all applicable taxes.
You are free to cancel your subscription at any time. For our part, we reserve the right to suspend or terminate your access to the Services in case of violation of these Terms. Heynds also reserves the right to modify, suspend, or permanently or temporarily discontinue the Services.
Warranties and Liability
Heynds provides its Services "as is," without any explicit or implicit warranty of uninterrupted availability or suitability for a particular purpose. In case of a dispute, our total liability is strictly limited to the total amount you have paid us for the Services over the past 12 months. You agree to indemnify Heynds against any claim or lawsuit arising from your use of the Services.
Intellectual Property
Heynds respects the intellectual property of others. If you identify a violation of your copyright, please inform us at support@heynds.com with the necessary legal justifications. We reserve the right to remove any contentious content and to deactivate user licenses in the event of proven or repeated infringement.
Disputes and General Provisions
These Terms are governed by French law, without regard to conflict of laws principles. Before initiating any legal action, you agree to contact our support to attempt to resolve the dispute amicably. In case of failure, the French courts will have exclusive jurisdiction.
These Terms constitute the entire agreement between you and Heynds, superseding any prior proposals. If any provision is found to be invalid, the other clauses will remain in full force and effect. Heynds may modify these Terms at any time: updates will be published on our platform, and you will be notified.
